Terms of Service

These terms are an agreement between you and KPZG LLC, doing business as ImgFact (“ImgFact”, “we”), for your use of imgfact.com and its services. By creating an account or using ImgFact you accept them. If you use ImgFact for an organisation, you accept them on its behalf.

1. What ImgFact is, and is not

ImgFact analyses images for signs of AI generation and editing, and compares images with each other. It is a first-pass screening tool. Its results are probabilistic and can be wrong: it can miss AI-generated or edited images, especially from the newest generators and when metadata has been removed, and it can flag genuine photographs. A result is not proof that an image is authentic or fake, and it is not expert testimony. Before relying on a result in a legal, insurance, financial or employment decision, have it reviewed by a qualified forensic examiner.

2. Your account

You must be at least 16 and give accurate account information. Keep your sign-in secure; you are responsible for activity on your account. Tell us at hello@imgfact.com if you believe it has been used without your permission.

3. Your images

You keep all rights to the images you upload. You give us permission to process them only to provide the service to you, as described in our Privacy Policy. We do not use them to train AI models. You confirm that you have the right to upload each image and that doing so does not break the law or anyone else's rights, including privacy rights of people shown in it.

4. Acceptable use

You may not:

• upload sexual content involving minors, or any content that is illegal to possess or share;
• use ImgFact to harass, stalk or defame anyone, or to make misleading claims about a person based on a result;
• try to get around plan limits, rate limits or security, or access other users' data;
• scrape, resell or build a competing service from ImgFact's output, or reverse engineer the service;
• overload the service or interfere with other users.

We may suspend or close an account that breaks these rules.

5. Plans and payment

• Free: 5 scans per calendar month (UTC). Unused scans do not carry over.
• Starter Pack: a one-time purchase of 10 scans that do not expire.
• Pro and Firms & SIU: monthly subscriptions, billed in advance through Stripe, with the allowance and features listed on the pricing page.

You can cancel a subscription at any time from your dashboard. It stays active until the end of the period you have paid for and is not renewed. Except where the law requires otherwise, payments are not refundable. We may change prices; a change to your subscription's price takes effect from your next billing period after we tell you about it.

6. Share links

A share link lets anyone who has it view that report and its preview image. Share only with people who should see it.

7. Our service

We work to keep ImgFact available and accurate, but we may change, add or remove features, and the service may sometimes be unavailable. Free plans are provided as they are. ImgFact and its software, design and reports (excluding your images) belong to us.

8. Disclaimers

To the extent the law allows, ImgFact is provided “as is” and “as available”, without warranties of any kind, including that results will be accurate or complete, or fit for a particular purpose.

9. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost profits, data or business, arising from your use of ImgFact or reliance on its results. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and US$100.

10. Indemnity

You will cover our reasonable costs from claims by others arising from images you upload or your breach of these terms.

11. Ending the agreement

You can stop using ImgFact and ask us to close your account at any time. We may end or suspend your access if you break these terms or if we stop offering the service; if we stop offering a paid plan, we will refund the unused part of any period you have paid for.

12. Changes to these terms

We may update these terms. We will post the new version here with its date, and email account holders about a significant change before it takes effect. Continuing to use ImgFact after that means you accept the new terms.

13. Law

These terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-law rules. Disputes will be heard in the state or federal courts located in Michigan, unless the law where you live gives you the right to bring a claim there.
